Intellectual property and copyright guidelines.

When selling digital products on the marketplace, sellers and buyers alike must respect and uphold intellectual property (IP) and copyright laws. The following guidelines are designed to protect creators’ rights and ensure fair use of all digital products available on the platform.

1. Originality of Content

  • All digital products uploaded to the marketplace must be original works created by the seller or used with the full permission of the original creator. Unauthorized copies, derivatives, or adaptations of someone else’s work without permission are strictly prohibited.
  • Sellers must ensure that their products do not infringe on the copyrights, trademarks, or other IP rights of third parties.

2. Licensed Content and Third-Party Elements

  • If a product includes third-party elements (e.g., fonts, stock images, templates), sellers are responsible for verifying and securing appropriate licenses for their use. Any licensing information and terms of use must be clearly communicated to buyers.
  • Products created with open-source resources or public domain assets should specify the terms of use and any attribution requirements as outlined by the original creator.

3. Trademarks and Branding

  • Sellers may not use logos, names, or images of recognizable brands, celebrities, or other trademarked materials unless they have explicit permission from the trademark holder. Misuse of trademarks is a violation of marketplace policies and IP laws.

4. Copyright Ownership and Rights Transfer

  • By listing a product for sale on the marketplace, the seller confirms that they either own the copyright to the product or have been granted permission by the copyright owner to sell it.
  • Sellers should clarify the rights buyers receive upon purchase, such as personal use only, commercial use, or full transfer of copyright, and include any restrictions to prevent misunderstanding.

5. No Impersonation or False Attribution

  • Sellers may not impersonate or falsely attribute products to other creators. All work must be properly credited if applicable, and the seller’s profile should reflect their true identity as the product creator.

6. Respect for Buyers’ Intellectual Property Rights

  • Sellers are prohibited from reselling any digital product purchased from other creators on the marketplace, modifying and claiming it as their own, or using it in ways that violate the original creator’s terms of use.

7. Prohibition Against Plagiarism

  • Any form of plagiarism is not tolerated. Sellers must ensure that all elements of their products, including images, designs, and text, are either created by them or used with permission from the original creator.

8. Reporting Copyright Infringement

  • If you believe that a digital product on the marketplace infringes on your copyright or IP rights, you may file a report with the marketplace’s support team. Provide details and supporting documentation, and the marketplace will review and take appropriate action.

9. Consequences of Violation

  • Violations of these IP and copyright guidelines may result in the removal of the offending product, suspension or termination of the seller’s account, and potential legal action, depending on the severity of the violation.

By adhering to these guidelines, sellers and buyers help maintain a trustworthy marketplace environment where creativity and innovation are respected and protected. The marketplace administration reserves the right to update these guidelines as needed and expects all participants to review and comply with the most current policies.
